A 24-year-old from Uganda is facing deportation from Norway as authorities claim the asylum seeker is faking his sexuality in an attempt to gain residency.

The man was arrested by plain clothes immigration police in the Court of Appeal this week while trying to plead his case to stay in the country.

Authorities attempted to prematurely deport the man—despite the fact the court has not yet reached a verdict.

Mads Andenæs - the man’s lawyer - says the arrest “surprised and upset” the asylum seeker.

“We have had a long court proceeding on the case, the trial was ended ten minutes ago and the case is closed for judgement," he said, adding: “whichever formal grounds invoked for deportation, it would be inappropriate and contrary to the separation of powers in our state government."

“It is the Court of Appeal, which will not decide whether he is granted asylum or not."

Andenæs made a successful injunction, meaning the man will not be deported until a judgement has been made by the court.

The 24-year-old has previously given evidence about his life as a gay man in Uganda, fearing he will be killed if he is forced to return.
